This partly wrong. Anyone who prays to other than Allah is a kafir (non-Muslim). It is not the case that a person must be taken to an Islamic court to be judged as a kafir (non-Muslim). What if someone comes up to you and says that he's Muslim. Then later (after being affected by christians)...
