It is permissible for a menstruating Woman to Read the Qur’an and the Books of Supplications?

Fatwa by: Shaykh ‘Abdul ‘Aziz ibn Baaz. (pg 50-51)

There is no problem in a menstruating or post-natal bleeding woman reading supplications written in books of hajj and also it is OK to read the Qur’an (without touching it) in the more correct of the scholar’s opinions. This is because no clear and authentic narration has been reported that prevents them from reading the Qur’an. What has been reported is with respect to the junub person that he or she is not permitted to read the Qur’an whilst the junub state. This is based on a hadith reported by ‘Ali r.a.

Regarding the menstruating and post-natal bleeding woman, a narration has been reported from Ibn ‘Umar r.a. that says:
“The menstruating and junub are not allowed to read anything of the Qur’an.”

However, this hadith is weak due to being narrated by a person by the name of Isma’il ibn ‘Ayyash who in turn reported it from the people of Hijaz. This person is weak when reporting from them, but she can read, say for example from her memory, without actually touching the Qur’an. However, the junub person is not allowed to read even from his memory or from the copy of the Qur’an (even without touching it) until a bath is taken.

The difference between the junub and the menstruating woman is that the junub person is in the state for only a short time and it is possible to take a bath as soon as jima’ is finished. So the period is not long and the matter is in the junub person’s hands when to have a bath. If it is not possible to use water for whatever (valid) reason, then tayammum can be performed and then they can pray and read the Qur’an.

As for the menstruating and the post-natal bleeding woman, then the situation is not in her hands but in the Hands of Allah, the Almighty. Both menses and post-natal bleeding require days, for which reason is permissible for them to read Qur’an so that they do not forget it and so that they are not deprived of the benefits associated with reading it, such as knowing the shari’ah rulings from the book of Allah.

On the basis of this, it is more so the case that she is allowed to read the books of supplications that contains verses, Hadiths and other things. This is the correct opinion and it is the more correct of the two saying scholars (may Allah have mercy upon them) in this issue.

Reciting the Qur'aan without wudoo'?

Answer:

It is preferable to recite it upon purification.

The hadeeth of the Messenger's (S) making tayammum to reply to "as-Salaamu 'alaikum".

It is not forbidden to recite it without wudoo'.

As for the woman in her period or in after-birth confinement, then nothing prevents her from reciting the Qur'aan.

The hadeeth that At-Tirmidhee reported from Ibn 'Umar (R) that the Messenger (S) said: "The woman in her period and the junub man may not recite the Qur'aan," then that is a 'munkar' hadeeth, as the Imaam of Sunnah Ahmad Ibn Hanbal says, it is not authentic.

Rather we have the hadeeth of 'Aa'ishah (R) that the Messenger (S) said to her when she made Hajj and she had her period: "Do everything the pilgrim does except prayer and tawaaf." Does not the pilgrim recite the Qur'aan? So this hadeeth is a clear proof of the permissibility of a woman's reciting the Qur'aan whilst in her period.

Therefore it is not permissible to prevent the woman in her periods from reciting the Qur'aan claiming that she is not pure! If Allaah ta'aala had prevented her from reciting as He prevented her from praying, then we would follow that prevention and that would be the end of the matter. But He revealed to His Messenger (S) a distinction between Prayer and its constituent parts; since some people say that reciting the Qur'aan is one of the pillars of the Prayer, so why do we not make purification a pre-condition for it as it is for the Prayer? So we say: Not only is reciting the Qur'aan a part of the Prayer, but also, Prayer is begun by our saying 'Allaahu Akbar'. So, we should also say that it is a requirement for saying 'takbeer' that we have wudoo'! And the same goes for 'tasbeeh', 'tahmeed' etc.

We find that some of the companions preferred to have wudoo' to touch the Qur'aan - so that shows what is preferable - but to make it obligatory and to say that it is forbidden for a woman in her period to touch the Qur'aan - then that has no proof at all.

Case:

The reciting of the Qur'an by a menstruating woman either via direct
looking or silently (in her heart) without the actual uttering by the tongue is
permissible. The majority of the scholars are with the opinion that it is not
prohibited for her to utter the Qur'anic recitation. Imam Bukhari, Ibn Jareer At-
Tabaree and Ibn Al-Munthir, Imam Malik, and Imam Ash-Shaafi'ee (in one of
his earlier sayings) are with the opinion that it is permissible for her to recite the
Ayah (verse in the Qur'an).
Shaykhul Islam Ibn Taymeeyah said: "Basically, there
is no Sunnah to prevent her from reciting Qur'an. The "hadeeth" that: "A
menstruating woman and the one who is in state of Jannabah* should not recite
anything of the Qur'an", is a weak hadeeth as agreed upon by the knowledgeable scholars of Hadeeth. In fact women at the time of the Prophet (SAAW) used to have their monthly cycles of menses.
Had the recitation of Qur'an been prohibited for them (as it is the case with Salat)
*Takbeer: saying Allahu Akbar (Allah is The Greatest); Tasbeeh: saying Subhana Allah (Most Glorified is Allah); Tahmeed: saying Al Hamdulil'lah: All Praise is due to Allah.
*Saheeh Al-Bukhari (Arabic-English) V.1, P.179, Hadeeth # 296.
*Agreed upon Hadeeth. In Saheeh Al-Bukhari (Arabic- English), V. 1, P. 192, Hadeeth # 321.
*Jannabah: Is the state in which a man (or a woman) has sexual discharge during sexual intercourse or in a dream, etc. In this state a Muslim is not allowed to pray or do other kinds of worships unless and until he (she) performs Ghusl (have a full shower) or do Tayammum if he/she cannot use water for any reason.*

then the Prophet (SAAW) would have made it clear to his Ummah (Islamic
community) and his wives would have known about it and they would have
dissipated this knowledge to the people. Because no one had related a prohibition by the Prophet (SAAW) about this issue, then it cannot be made unlawful especially when it is known that he (SAAW) did not prohibit it at the time when menses was very much present. Accordingly, recitation by the tongue is not Haram (legally unlawful).*This author said: "having known the dispute between the scholars about this matter, then it is more proper for the menstruating woman not to recite Qur'an by the tongue except when it is necessary e.g. if she is a teacher or if she is preparing for an exam."

Riguardo alla tua domanda, sorella, ho trovato una fatwa in inglese del Comitato Permanente in Arabia Saudita, che dice:

Question:

What is the ruling concerning a woman who had her menses during the days of her Hajj? Is the Hajj she performed valid?

Response:

If a woman gets her menses during the days of Hajj, she performs all of the deeds of the Hajj except for the tawaaf of the Ka'bah and the going between the hills of as-Safaa and al-Marwah. She does not do those acts until she becomes pure. When she becomes pure, she makes ghusl, and performs the circumambulation and the circuits. If the menses come and the only rite she has not performed is the tawaaf al-wadaa', then she goes home without performing it as it is no longer required of her [due to her state] and her Hajj is correct. The basis for this is what is recorded by at-Tirmidhee and Abu Daawood from 'Abdullaah ibn 'Abbaas that the Messenger of Allaah (sal-Allaahu `alayhe wa sallam) said:

«The woman with post-partum bleeding and the menstruating women, when they come to the miqat [the place to enter the state of ihraam] are to make ghusl, enter the state of ihraam and perform all of the rites of the Hajj save for the circumambulation of the House [Ka'bah]».

In the Saheeh, it is recorded from 'Aa.ishah that she had her menses before completing the rites of the 'Umrah and the Prophet (sal-Allaahu `alayhe wa sallam) told her to enter the state of ihraam for Hajj and to not tawaaf the House (Ka'bah) until she was pure. He told her to do all of the rites of the Hajj and to combine it with the 'Umrah. Al-Bukhaaree recorded from 'Aa.ishah that Safiyyah, the wife of the Prophet (sal-Allaahu `alayhe wa sallam), received her menses and mentioned that to the Messenger of Allaah (sal-Allaahu `alayhe wa sallam). He said:

«Is she going to hold us up?»

...they said, "She has already made the tawaaf al-ifaadhah." He said:

«In that case, she is not [going to hold us up]».

In another narration, 'Aa.ishah said, "Safiyyah had the menses after she finished the tawaaf al-ifaadhah. I mentioned her menses to the Messenger of Allaah (sal-Allaahu `alayhe wa sallam) and he said:

«Is she going to hold us up?»

...I said, 'O Messenger of Allaah, she has already performed the tawaaf al-ifaadhah of the mosque.' So the Prophet (sal-Allaahu `alayhe wa sallam) said:

«Then let us go».

And with Allaah lies all success and may Allaah send prayers and salutations upon our Prophet (sal-Allaahu `alayhe wa sallam) and his family and his companions.

La lettura del Corano da parte di una persona senza abluzione

Fatawa Muhammad Halil Herras , pag 124
