Asalamualikum, a sister i know is very confuse...i am trying to help her find an answer for her question. but unfortunetly so far, she is getting completely different answers, she is still confuse...i thought i should post her question here and see if any one can help.


the father is earning his income through a haram mean, ie selling wine. Is it permissible for his children to use his money? Would they get sin for it? If he offered money to them, they fear by rejecting it they might cause him distress and lead to more fitna. Can they give that money to charity instead so the father is not upset with them?

so she wants to know:
a)whether she can accept his money and spend it?
b) if no, then can she still take the money BUT give it to charity to avoid causing problems

ps. the father is fully aware his income is haram, but he is reckless toward it. so there is no point of her giving dawa' cz he already knows and just dont care :S

As for the wealth that comes from dealing in alcohol, that is subject to further discussion:

1 – If it is still there it must be got rid of, by giving it to the poor and needy, and donating it to charitable causes, because it is impure wealth that is not permissible for the one who acquired it.

It says in Fataawa al-Lajnah al-Daa’imah (14/61) concerning one who acquired wealth by selling haraam things such as alcohol:

The Prophet (peace and blessings of Allaah be upon him) said: “O people, Allaah is Good and only accepts that which is good. Allaah commanded the pious to follow the same commandments as He gave to the Messengers. He says (interpretation of the meaning):

‘O (you) Messengers! Eat of the Tayyibaat [all kinds of Halaal (lawful) foods which Allaah has made lawful (meat of slaughtered eatable animals, milk products, fats, vegetables, fruits)] and do righteous deeds. Verily, I am Well-Acquainted with what you do’ [al-Mu’minoon 23:51]

‘O you who believe (in the Oneness of Allaah — Islamic Monotheism)! Eat of the lawful things that We have provided you with’ [al-Baqarah 2:172]

Then he mentioned a man who has travelled on a long journey and is dishevelled and covered with dust; he stretches forth his hands to the heaven, (saying) “O Lord, O Lord”, but his food is haraam, his drink is haraam, all his nourishment is haraam, so how can he du’aa’ be accepted?” Narrated by Muslim in his Saheeh.

Hence it haraam for the Muslim to deal in haraam things. The one who does any such thing must repent and give up the haraam earnings. There are many permissible ways of earning a living – praise be to Allaah. Allaah says (interpretation of the meaning):

“And whosoever fears Allaah and keeps his duty to Him, He will make a way for him to get out (from every difficulty).

3. And He will provide him from (sources) he never could imagine”

[al-Talaaq 65:2-3]

If a person repents and has wealth that he acquired by haraam means, such as riba and gambling, or selling haraam goods such as alcohol and pork, he must get rid of that wealth by donating it to public projects, such as repairing roads and public washrooms, or he may distribute it to the needy. He should not keep any of it or benefit from any of it because it is haraam wealth in which there is no goodness. Repenting from that means that he must get rid of it and keep away from it, and find another way of earning a living. End quote.

Here's a fatwa from ISLAM Q & A which i hope will help

Expenditure is obligatory upon a father to his son/daughter according to the Islamic law and shari'ah, as regards his/her housing, clothing, food, drink and the like. However,the requirement according to Islamic shari'ah are:

that the person spent upon is poor or does not own anything, or does not own or possess what is enough for his requirements and is unable to gain their own income. that the one spending and the one spent upon are of the same religion.

When the son/daughter is in need for expenses, then he/she is allowed to take from his/her father's earning even though it is haraam (forbidden). In such a case his/her du'aa' to Allaah won't be affected, since being a minor, he/she has neither might nor power. But while doing so, he/she should abide by the following observations:

Not to expand and widen the scope of taking or accepting from his/her father's illegitimate earnings. He/she should try if he/she is able to earn a halaal income to become independent and self-sufficient and no longer in need of the father's support. To try as hard as possible all ways to admonish and advise his/her parents in the hope that Allah Almighty may guide them towards repentance from haraam earnings.
