Astaghfirullah, what are these so-called "muslims" doing, capturing women against their will and keeping them away from their husbands and fathers? Why are they not releasing them? Are muslim armies around the world ready to attack so as to preserve the dignity and honour of these women?

Muslim men are not allowed to have contact with women - whether they are muslim women or non-muslim women.

This sounds like Boko Haram- group which kidnapp schoolgirls and women in Nigeria and then sells them as slaves - or sex slaves.

Assalamu alaikum

In another thread I am discussing the theoretical basis of everything ISIS is doing. For that I have raised some questions, which I am trying to answer myself. Maybe I should have taken this question in my list too. But I will briefly discuss it here and keep that issue separate, InshaAllah.

Like in the study of Aqaed, we are taught, that they are a basis of all deeds, there is always some theory, some Fataawa behind such actions. I want to draw the attention of the respected sisters to the famous statement of Sheikh Saleh al-Fauzan: “Slavery is part of jihad, and jihad will remain as long there is Islam.” Opinions like this are bearing fruits.

Slavery is one of those topics, where muslims as a whole have ignored the clear directives of Quran. According the laws laid in Surah Muhammad, war captives have to be freed after getting Fidya or without Fidya as a means of Ihsaan. Sadly, Sheikh Fawzan is certainly not the only one, who has his own reasons to include a third option, which is not in Quran: keeping them as slaves, in worst case for ever and for all generations to come.

I am just trying to show, that everything what they are doing is according to the Fataawa of the same scholars, who are now bound to criticize them. I don't accept their criticism. They are least entitled to criticize ISIS. ISIS is the fruit of their own Fataawa.

There is a second reason, which is also valid for the other case of those Pakistanis invovled in child sex, about whom you have started another thread. And that is the dehumanization of non-muslims by constant repitition of the word kaafir kaafir kaafir. Their victims were most probably white christians. Obviously, they had much less inhibitions about them compared to muslim children. Such things do not have to be taught. It is in the atmosphere we have created.

[adding after a few minutes: ] In Surah al-Baqarah, in the charge-sheet against Bani Israel, we read, they had made the wealth of "ignorants" (meaning non-jews) halaal for themselves. We should now think what we are doing? We have made the lives, wealth and honour of kuffaar (meaning non-muslims) halaal for ourselves.

ISIS is young. Women are scarce. Opnions like the one quoted above are a great help.

Assalamu alaikum,

For those, who may think, I am putting words in Sheikh Fawzan's mouth, I am giving a link of a Fatwa, which discusses the issue at length:

http://islamqa.info/en/94840

Here is an excerpt from the same Fatwa:

Shaykh al-Shanqeeti (may Allaah have mercy on him) said: The reason for slavery is kufr and fighting against Allaah and His Messenger. When Allaah enables the Muslim mujaahideen who are offering their souls and their wealth, and fighting with all their strength and with what Allaah has given them to make the word of Allaah supreme over the kuffaar, then He makes them their property by means of slavery unless the ruler chooses to free them for nothing or for a ransom, if that serves the interests of the Muslims. End quote from Adwa’ al-Bayaan (3/387).

In my next post, I will post an article, which reflects my understanding of the issue.

Wassalamu alaikum

Slavery

And if any of your slaves ask for mukātabat, give it to them if you know any good in them and [for this] give them out of the wealth which Allah has given to you. (24:33)

The above quoted verse of Sūrah Nūr mentions the directive of mukātabat. At the time of the revelation of the Qur’ān, the institution of slavery was as essential to the economic and social needs of the society as the institution of interest is considered in present day societies. In markets, slave-men and slave-women were bought and sold, and affluent houses had slave-men and slave-women of all ages. In such circumstances, a sudden directive for their emancipation would have resulted in many evils: for livelihood, men would have been forced to resort to beggary and women to prostitution. For this very reason, the Qur’ān adopted a gradual way to eradicate this evil from the society and after many gradual measures of eradication, the above quoted verse revealed a directive for their liberation. The word “mukātabat” used in it as a term which means that a slave make a contract with his master according to which he would be required to pay a certain sum of money in a specific time period or would carry out a specific service for his master; once he successfully fulfills either of these two options, he would stand liberated. In the above quoted verse, the Almighty has directed the Muslims to necessarily accept this contract made by a slave if he wants to make it and has the required ability to become financially independent. It is further stated that a Muslim government should spend money from the public treasury, which here is called the treasury of God, in helping such slaves. It is evident from the words of the verse that just as this right of mukātabat was granted to slave-men, it was also granted to slave-women. This, in other words, was in fact a declaration that slaves could now be masters of their destiny and could obtain liberation whenever they wanted.

The above stated verse is the last directive regarding slavery. Prior to this, various other directives were given at various stages because of which it gradually became possible for this evil to be eradicated from the society. These are summarized below:

1. In the very beginning of its revelation, the Qur’ān regarded emancipation of slaves as a great virtue, and urged people in a very effective way to do so. The tremendous appeal found in the words it adopted فَكُّ رَقَبَة (release the necks) can be well imagined by a person who has flare for the language. It is evident from the context of such expressions – wherever they are found in the Qur’ān – that it has regarded this virtue to be the first as well as the greatest step in pleasing God.93

In a similar manner, the Prophet (sws) also urged Muslims to liberate humanity from the yoke ofslavery in the following words: “Whoever liberated a Muslim slave, the Almighty in return for every limb of that slave would shield every limb of that person from Hell.”94

2. People were urged that until they free their slaves they should treat them with kindness. The way their masters had total and unchecked control on them in the age of ignorance was put an end to. They were told that slaves are human beings too, and no one should in any way violate the rights they possess as human beings.

Abū Hurayrah (rta) narrated from the Prophet (sws): “Slaves have a right to food and clothing and he shall not be asked to carry out an errand that is beyond him.”95

Abū Dharr Ghaffārī (rta) narrates from the Prophet (sws): “They are your brothers. The Almighty has made them subservient to you. So whatever you eat, feed them with it, whatever you wear, clothe them with it and never ask them to do something which is beyond them and if there is such a task then help them out with it.”96

Ibn ‘Umar (rta) narrates from the Prophet (sws): “Whoever slapped a slave or beat him up should atone this sin by liberating him.”97

Abū Mas‘ūd (rta) says: “Once when I was beating my slave I heard a voice from behind me: ‘O Abū Mas‘ūd you should know that the Almighty has more power over you.’ When I turned back, I found that it was the Prophet. I immediately remarked:

‘O Messenger of God, I release him for the sake of God.’ The Prophet said: ‘Had you not done this you would have been given the punishment of the Fire.’”98

Ibn ‘Umar (rta) narrates that once a person came to the Prophet (sws) and asked: “How many times should we forgive our servant.” [At this], the Prophet kept quiet. He asked again and the Prophet again kept quiet. Upon being asked the third time, he answered: “Seventy times in a day.”99

3. In cases of un-intentional murder, ẓihār, and other similar offences, liberating a slave was regarded as their atonement and ṣadqah100.

4. It was directed to marry off slave-men and slave-women who were capable of marriage so that they could become equivalent in status – both morally and socially – to other members of the society.101

5. If a person were to marry a slave-woman of someone, great care was exercised since this could result in a clash between ownership and conjugal rights. However, such people were told that if they did not have the means to marry free-women, they could marry, with the permission of their masters, slave-women who were Muslims and were also kept chaste. In such marriages, they must pay their dowers so that this could bring them gradually equal in status to free-women. The Qur’ān says:

If any of you have not the means wherewith to wed free believing women, he may wed believing girls from among those whom you own: and Allah has full knowledge about your Faith. You are one from another: wed them with the permission of their owners, and give them their dowers, according to the norms; [the only condition is that] they should be kept chaste, neither being lustful, nor taking paramours … This permission is for those among you who fear sin; but it is better for you that you practice self-restraint. And Allah is Ever-Forgiving, Most Merciful. (4:25)

6. In the heads of zakāh, a specific head الرِّقَاب فِى (for [freeing] necks) was instituted so that the campaign of slave emancipation could receive impetus from the public treasury.102

7. Fornication was regarded as an offence as a result of which prostitution centers that were operated by people on the basis of their slave-women were shut down automatically, and if someone tried to go on secretly running this business, he was given exemplary punishment.103

8. People were told that they were all slaves of Allah and so instead of using the words عَبْد (slave-man) and اَمَة (slave-woman), the words used should be فَتَى (boy/man) and فَتَاة (girl/woman) so that the psyche about them should change and a change is brought about in age old concepts.104

9. A big source of the institution of slavery at the advent of the last Prophet (sws) was the prisoners of war. The Qur’ān rooted this out by legislating that prisoners of war should be freed at all costs – either by accepting ransom or as a favour by not taking any ransom money. No other option was available to the Muslims.105

Isis brings back slavery: Yazidi girls sold to Isis fighters as concubines for $1,000

200

Reports are emerging of young Yazidi women, captured in northern Iraq, being sold to Isis fighters as concubines, while the jihadist group claims they can be enslaved under Islamic law

Isis has boasted that it had enslaved women from an Iraqi minority group to use as concubines, as a human rights organisation reported teenagers being bought and sold by fighters for $1,000 (£622).

An English-language propaganda magazine for Isis said Yazidi women and children were considered spoils of war after they were captured as the militants seized their towns and villages. It was the first confirmation from the group of widespread allegations of detention and sexual abuse against Yazidi women.

Hundreds of thousands of members of the ancient sect were displaced as Isis fighters swept through the Sinjar area of northern Iraq in August, prompting US President Barack Obama to warn of an unfolding genocide. Those who escaped said men had been massacred while hundreds of women and children had been detained.

Isis systematically separated young women and teenage girls from their families, Human Rights Watch said in a new report.

“[Isis’s] litany of horrific crimes against the Yazidis in Iraq only keeps growing,” said Fred Abrahams, a special adviser at HRW. The group documented 366 Yazidi captives but also reported that some detainees reached by phone said the number was more than 1,000. The Iraqi government said 1,500 women were detained during the advances in the Sinjar area, which is also home to Christian and Shiite minorities.

One 15-year-old girl, interviewed after she had escaped, told the group that a Palestinian Isis militant had bought her for $1,000.

The women and children were divided among fighters according to Islamic law, the Isis magazine, Dabiq, said.

“The enslaved Yazidi families are now sold by the [Isis] soldiers,” it continued. The article argued that although Christians and Jews can be offered the chance to pay a tax or convert, Yazidis, as polytheists, can be enslaved if captured during war.

It details the argument for enslavement under its extremist interpretation of Islam, boasting that it is the largest mass-enslavement since the early days of the religion.

“One should remember that enslaving the families of the [nonbelievers] and taking their women as concubines is a firmly established aspect of Islamic law,” the magazine said. “Their creed is so deviant from the truth that even cross-worshipping Christians for ages considered them devil worshippers and Satanists.”

The rejection of slavery had led to an increase in adultery and fornication, it said, because men who couldn’t afford marriage found themselves surrounded by temptation, including by maids. “If she were his concubine, this relationship would be legal,” it said.

None of the Yazidi women interviewed by HRW said they had been raped, but sexual assault is deeply stigmatised in the conservative sect.

One interviewed by the group said she’d seen “brides” taken from both a school and prison she was held in. “Some were as young as 12 or 13, and up to age 20,” she said. “Some of the young women were married but without children, so [the Isis soldiers] didn’t believe they were married.”
