but here is a little story of how a fatwa was given to solve a serious problem.
Background of the scene:
Harun Rashid was a khalifa at the time one of Abu Hanifa, ra students was given authority to make ruling. The student was Abu Yusuf, ra. Abu Yusuf was poor and had to work for his family at a young age. He used to sit in halaga(gathering) of the scholar Abu Hanifa. Abu Hanifa, told him to leave because in order to sit with them, he must have memorized the Quran.
Abu Yusuf left and in about 2 years memorized the Quran, and came back to sit with Abu Hanifa. He used to sit in and listen to the sheik until he started not showing up some days. Abu Hanifa went out to find Abu Yusuf and asked what the problem was why he didn't sit in. Abu Yusuf, said his family depends much on him for support. Abu Hanifa, then told him that he will support him and his family, so he can sit in with him. Abu Hanifa, ra, ended up supporting him and his family for 10 years.
Later on Abu Yusuf, became a judge of the judges for the abysid khalifa with the caliphate, Harun Rashid.
The problem:
Harun Rashid, had an argument with his wife one night that escalated to a point he made an oath, were he said he will divorce her except if she leave his kingdom that night. Now the area of rule of this khalifa was so vast that it would be impossible to leave at that time with the method of traveling they had. His rule was from india to morroco and up to to north of Iraq to northern Africa.
so he came to the judges he had, with this problem. He didn't want to divorce his wife, he did it when he was angry. And an oath is an oath. When we swear by Allah (wAllahi) it must be complied with. So the situation was looking very grim.
The question: how can she leave his kingdom in one night as per his oath. The judges looked at the situation very carefully. They concluded that it was impossible and he has no choice but to divorce his wife. Traveling in those days by horse or other means will not get her outside of the kingdom in 1 night.
Abu Yusuf, that little boy, is now a grown up judge, intelligent and gifted and this matter was directed to him.He said ya ameer almumineen, you don't need to divorce your wife because she can leave his kingdom within this night. The caliphate Harun, was extremely interested, he was happy now he has cooled down, he didn't want to divorce his wife. Other judges wanted to know as well. They couldn't believe it. It is impossible for her to leave his kingdom in a night.
Solution the fatwa goes like this:
She will have to go to the masjid, for the night thats all. Everybody was shocked, the masjid near the home of the khalifa. That is not outside of the kingdom said the Harun and the masjid is inside his kingdom. Abu Yusuf, said, the house of Allah, masjid, is not in his kingdom, it belong to Allah, and it is the kingdom of Allah.
Can you think like this?
Not like today, where it would of been said: Harun Rashid you did such a stupid mistake. don't you think, ... na na it's haram, ok fast 2 days, no no better yet go feed 10 poor people.
No No, as per Abu Yusuf, just go sleep in the mosque. The mosque and the palace are close to each other. The issue was resolved. The khalifa didn't have to divorce his wife. She stayed in the mosque that night and returned to her husband.
Thought I share this story. Rahmat Allah alayhum, the intelligence of these scholars and how they dealt with situations is amazing. Also the insight that the scholars had in their students was very keen, and included a lot of patience. MashAllah.
