Are Finders Keepers?

The Prophet (sal Allahu alaihi wa sallam) was asked about a Luqata (money found by somebody). He said: “Remember and recognize its tying material and its container, and make public announcements about it for one year. If somebody comes and identifies it (then give it to him), otherwise add it to your property.” [Sahih Bukhari]

If someone’s wallet, purse or other valuables are found, then a Muslim cannot operate on the principle of “Finders keepers, losers weepers.” It is forbidden to use that wealth unless one makes public announcements regarding it for a whole year. It should be a general statement letting people know that lost property has been found. Whoever claims it to be his/hers, should provide its identifying features to prove that it really is theirs.

Note that the Prophet (sal Allahu alaihi wa sallam) did not say to count how much money was inside and use that to identify who it belongs to. He only said to look carefully at the bag and the material with which the bag is tied. Looking at the money might unnecessarily tempt a person to use it. Thus, we were not told to look at it.

Should no one come to claim the lost property for a year, it may be used by the finder. If one cannot have the public announcements made, then he/she should not pick up the lost property.
