AsSalaam Alaykum, if parents have 4 sons &. 1 daughter can they decide to give the daughter more than the sons, or do they have to give what the shariah says? Also if a woman husband dies is it ok for him to tell his family he wants to leave his estate to his children and wife only or is this not allowed ?

Jazakillah khair, the daughter gets half of what the brothers get if done under Shariah law,but not all muslims do it correctly

Under this scenario the daughter would get very little, which would cause her severe poverty unless she was married or her brothers agreed to support her (most brothers do not support their unmarried sisters, especially if the brother is married with children).

Assalaam alaikum,

There is always wisdom behind Sharia. What is needed is an explanation of the ayats. There are twelve categories of possible inheritors. A person must pay his debts before entering the grave. For Muslims living in the west it is important to have a will.
You raise a good issue. We, Muslims, are very ignorant of our deen. If you live in the west become familiar with capital gain taxes and formulas. Learn the difference gift and gain. In the US there is a cut-off. If the house is worth under a specific amount you deduct that from a total life credit..it changes every year. You do not have to pay taxes. If it over the amount you have to pay. Crazy!!!

Sister Precious Star brings out an excellent point. Our communities are deaf and dumb when it comes to the welfare of the sisters. We choose ignorance about our sisters. We are hypocrites I have heard two sheiks come out and say what we are doing to our sisters is making them public property. This stems from the division of the state and religion. This is also a way of practicing Islam without being responsible and allowing the state to be the ultimate decision maker.
