Marrriage issue....questions....?

brothers and sisters in Islam

A problem come inquiry.

It is happening at a wide range.....so wide range....dont know...whether it is in the Shari'ah of Islam.
There are a millions of marriage agencies in my country.....there is a man who arranges the marriage....a kaazi....
The adult couples,the love each other(even some r not adult..they also go against the law of the country) go against their family(in private....they dont tell their parents)and with some(2/3 friends....i actually dont know....coz i never been there)friends as witness and they sign for marriage and witness..the kaazi declare them as husband and wife.
and they use to spend night together.....to meet their......and their family never knows!!!.....
sometimes after a time they told their parents and after a long term of argument the parents alllow them.but sometimes it happens that their relation doesnt last and they break-up....even they r physically related...they just cover their pasts.Astagfirullah...
The boy and girl then marry separately.......to other persons....how can the next bonding going to be happy...or atleast going to be last for a time.

now the Questions are:
01.Is it Lawful...to marry like this.....even if the Walid(or responsible parents are) present but not informed...i mean in the presence but absence of the parents.
02.Is it ok to take the witness of the friends.....i don know much but....as far I know there should be from the both side and should be responsible person like uncle,grand-father.......
03.Can we call it marriage(is that is the Islam,the Prophet (SAWS) taught us?...to marry against/without informing the parents and blood relatives)...or will that marriage be granted?....are not they living unlawful..if they maary so?

Actually don know much about the law of marriage....but inshallah i have the minimum knowledge to mark the afforesaid marriages to beunlawful.

Inshallah will have responsive reply.....a very important topic I guess...
Actually some of my friends and relatives also doing like this....Im very worried about them...so Im posting this thread.

in order to be married islamically these things are required

If any of these things are not there the marriage contract is not complete islamically.

So to answer 1st part of your Question a wali consent is required,

Abu Musa al-Ash'ari (S), 'Abdullah Bin 'Abbas (S), Jabir Bin 'Abdillah (S) and
Abu Hurayrah (S) reported that Allah's Messenger (N) said:
“A marriage (contract) is not valid without a wali.” (Recorded by Abu Dawud, at-Tirmidhi, and others. Verified to be authentic by al-Albani (Irwa'ul-
Ghalil no. 1839)

'A'ishah (T) reported that the Messenger (N) said:
“Whichever woman marries without her wall's permission, her marriage is
void, her marriage is void, her marriage is void. If he (the husband) performs
intercourse with her (despite the invalidity of their marriage), the mahr
becomes her right because he had access to her private parts. And if they
dispute (with the wali about this or other matters), the ruler would then be
the wali of the one who does not have a wali. ” (Recorded by Ahmad, Abu Dawud, and others. Verified to be authentic by al-Albani (Irwa'ul-
Ghalil no. 1840).

Another condition for the validity of a marriage contract is the presence of at least
two trustworthy Muslim male witnesses. ‘A’ishah (T), 'Imran Bin Hasayn (S),
and Abu Musa al-Ash'ari (S) reported that the Prophet (N) said:
“A marriage (contract) is not valid without a wali and two trustworthy
witnesses.” (Recorded by Ahmad, Ibn Hibban, and others. Verified to be authentic by al-Albani (Irwa'ul-Ghalil no. 1839, 1858, 1860).

03.Can we call it marriage(is that is the Islam,the Prophet (SAWS) taught us?...to marry against/without informing the parents and blood relatives)...or will that marriage be granted?....are not they living unlawful..if they maary so?

Like we discussed before a women cant be married without her wali consent, a wali would be her father in most cases , if he is non muslim or not there, then it would be grandfather, brother or uncle and if they are all non muslim than her shariah guardian would be her wali but she may not appoint her own wali, but if the wali is being hard for unislamic reason and not allowing her to do wat Allah (swt) has allowed then she can protest with muslim authority and change the wali

comeon bro :p its not that i just have studied this stuff so i knew, i can only recommend books and stuff i know anyone is more than welcome to ask but im not ur man, the guidance and help is in the hand of Allah (swt), but it would be my honor if Allah (swt) chose me to share his knowledge given to me to other people.
