assalamu alaykum,

I deleted the article/fatwa, because it was not from a good source. The person had quoted from not so authentic books. Also, his answer was wrong.

This is to do with Jews and Christian who actually believe in God who do slaughter.

There are hadith which show that the Prophet Muhammad :saw: would buy meat from Jews. As well as the general permisibility to eat meat from Ahlul kitab or marry to them in the Quran. (Surah Ma'idah 5:5)

Those who say Ahlul Kitab today do not exist as they were at time of Prophet :saw: are incorrect. - Whilst, it is true that many do not believe in Allah, if that is the case, then they are not Christian / Jewish !

So, the meat of Kosher butcher or that of a Christian, is halal. However, if it is not slaughtered in right way, i.e. they kill it by stunning it or shooting it in the head with a bolt or something, then this is not allowed. Most butchers in the West kill like this.

If you were in Middle East, a place where there are both Christian, Muslims living together and often with very similar practises, you will find that their slaughter is similar to that of Muslims.

For some people, these sort of topics are difficult to get around. That is because they were brought up thinking in a certain way.

These days, many people mix their incorrect thinking sometimes based on cultural interpretation with the real Islam. So, they end up making the Haram Halal and the Halal Haram.

If something is stated in Qur'an and Hadith, then it must be accepted.

Here we are discussing about those who are infact Christian or Jewish. That they do Shirk such as saying Jesus is son of God or worshipping Jesus is a different thing. They are still people of the book, Ahlul Kitab. - And Ahlul Kitab are disbelievers.

Permissibility of eating meat slaughtered by Christians and Jews
I have read several articles on what foods are halal and what foods are haraam. But when I go to a restaurant I still [doubt] if what I am eating is halal. I know that the meat needs to be slaughtered in the name of Allah, and it shall be done by the people of the book. Currently in the United States, the Christians and the Jews don't follow the true Bible and the Torah. The Christians call Isa (may Allah be pleased with him) the son of God. Is the meat cut by these people halal, can it be eaten?

Al-hamdu lillah (praise be to Allah).al-hamdu lillah (all praise be to Allah). The Christians and the Jews of the People of the Book in our times are indeed those People of the Book that are mentioned in the texts of shari'ah in the Qur'an and sunnah, and they are the kuffar (Disbeliever) of the Jews and Christians that existed at the time of the Prophet (peace be upon him). They are the people of the corrupted Torah and corrputed Injeel, as evidenced by the fact that Allah (swt) addressed them and named them "People of the Book" despite their being kuffar and their books being corrupted, as indicated in the following interpretations of the meanings of the aayaat:

Aala 'imran: 70:
O People of the Book! why do you reject the Signs of Allah, of which you are (yourselves) witnesses?

Al-maa'ida: 15:
O People of the Book! there has come to you Our Messenger, revealing to you much that you used to hide in the Book, and passing over much (that is now unnecessary): There has come to you from Allah a (new) light and a perspicuous Book.

Al-hashr: 2: (in regards to the Battle of Bani al-Nadeer):
It is He Who got out the Unbelievers among the People of the Book from their homes at the first gathering (of the forces)…

These kuffar among the People of the Book have certain abrogating qualities distinguishing them from the rest of the kuffar, by virtue of the fact that they are recipients of heavenly guidance and are people of previously revealed divine books—even though they corrupted them—unlike the remainder of the kuffar who have neither a previous book nor messenger, such as the Hindus, the Sikhs, the Buddhists, the communists, and others.

Because of this distinguishing quality, the shari'ah has specified special rulings particular to the People of the Book, and exceptions specific to them in some rulings, such as allowing marriage to the the chaste and virtuous (whether virgins or previously married) among their women and the permissibility of eating their slaughtered meat, as indicated in the following ayah (interpretation of the meaning):

Maa'ida: 5
This day are (all) things Good and pure made lawful unto you. The food of the People of the Book is lawful unto you and yours is lawful unto them. (Lawful unto you in marriage) are (not only) chaste women who are believers, but chaste women among the People of the Book, revealed before your time, when you give them their due dowers, and desire chastity, not lewdness, nor secret intrigues…

The preceding discussion is in regards to the general ruling with respect to slaughtered meat of the People of the Book; as for the specifics, the slaughtered meat of People of the Book can be one of several cases:
That he slaughters it via the known way specified by shari'ah and he speaks the name of Allah upon it. In this case there is no problem in the permissibility of eating it.

That he does not slaughter it by the way specified by shari'ah as is the case if he chokes it or electrocutes it until it dies or drowns it in water until it dies or kills it by a bullet, etc. In this case there is no doubt that eating it is forbidden since it is maita (meat of an animal that has died without properly being slaughtered) and Allah has forbidden it in the Qur'an (interpretation of the meaning): "… and forbidden unto you is maita…"
(al-Maa'ida:3)

That he mentions the name of someone or something other than Allah upon it as he is slaughtering, such as the Messiah or otherwise. Likewise there is no doubt that the meat in this case is haraam, since it is among what has been dedicated to other than Allah, which is specifically forbidden in the ayah in surat al-Maa'ida: 3 (interpretation of the meaning): "Forbidden to you (for food) are: maita, blood, the flesh of swine, and that on which has ben invoked the name of other than Allah; that which has been killed by strangling or by a violent blow…"

That we receive their meat and we don't know if it has been slaughtered properly or not. In this case the rule of thumb is that if we don't know the way of slaughter, the default is that it is permitted if it has been slaughtered by Muslims or Ahl il-Kitaab (Fatawa Islamiyya, Sheikh Abdel-Aziz Bin Baz, 3/404), as per the generally encompassing ayah (interpretation of the meaning) "and the food of the people to whom have been revealed the Book is permitted for you." (al-Maa'ida:5) If it becomes evident to us that they have not slaughtered it properly then it would not be permisible.

That we receive their meat and we don't know what they have mentioned upon it, and in this case likewise the preferrable and recommended opinion is the permissibility of eating it, as per the hadith in Sahih al-Bukhari via Aa'isha (may Allah be pleased with her) that some people said to the Prophet (peace be upon him) that a people come to them with meat which they do not know whether they have mentioned the name of Allah upon it or not. The Prophet replied "Mention the name of Allah upon it and eat it."

Islam Q&A

Meat in restaurants in non-Muslim countries

I want to know the rule on eating meat chiken and fish in non muslem countries ,in their restrunts as they are not following the islam rule on that.Is just sayiing the name of god on that food before eating is enough.

Praise be to Allaah.
The meats available in non-Muslim countries are of different types:
-- Fish is halaal in all circumstances, because its being halaal does not depend on how it is slaughtered or whether the name of Allaah is mentioned over it.

-- With regard to other kinds of meat, if those who slaughter it – companies or individuals – are from the People of the Book, Jews or Christians, and it is known that they do not kill the animals by means of electric shocks, strangulation or blows to the head, as is known in the West, then the meat is permissible. Allaah says (interpretation of the meaning):

“Made lawful to you this day are At-Tayyibaat [all kinds of Halaal (lawful) foods, which Allaah has made lawful (meat of slaughtered eatable animals, milk products, fats, vegetables and fruits)]. The food (slaughtered cattle, eatable animals) of the people of the Scripture (Jews and Christians) is lawful to you and yours is lawful to them”
[al-Maa’idah 5:5]

But if they kill the animals by means of some of these methods (electric shocks, etc), then the meat is haraam, because in that case the animals are counted as having been killed by strangling or by a violent blow (cf. Al-Maa’idah 5:3). If those who slaughter the meat are not Jews or Christians, then the meat that they offer is haraam. Allaah says (interpretation of the meaning):

“Eat not (O believers) of that (meat) on which Allâh’s Name has not been pronounced (at the time of the slaughtering of the animal), for sure it is Fisq (a sin and disobedience of Allâh)”
[al-A’naam 6:121]

So the Muslim must strive to avoid what is obviously haraam, and be cautious of doubtful things, and be keen to keep his religious commitment safe and to protect his body from haraam foods.

salam brother Mabsoot:

Thank you very much for the article. To be honest i was in search of that....

Just to make discussion shorter and easier to follow or just to conclude your article, below are some points that one needs to follow (please correct me if i am wrong).

Alhe-kitab food is halal for us. Because it has been cleraly stated in Surah Al-Maa’idah, 5:5

"The food of the People of the Book is Halal for you and your food is Halal for them."

However there are some condition imposed on us which determine wheter the food is halal or haram. And these conditions apply equally to muslims and non muslims. Some of the conditions are mentioned in Surah al-Ma’idah, 5.3

“Forbidden to you (for food) are: dead meat, blood, the flesh of swine, and that which has been invoked the name of other than Allah, that which has been killed by strangling, or by a violent blow, or by a headlong fall, or by being gored to death, that which has been (partly) eaten by a wild animal, unless you are able to slaughter it (before the animal dying due to the above causes).”

So before eating either meat of muslims or non muslims (ahle-kitab i mean) these conditions must be meet.

Hence the meat which is not slaughtered the hilal way is HARAM. The meat on which other than ALLAH name is mentioned is HARAM.
