Can a wali (male guardian of a female..can be a father..if not..then a brother..if not..then a paternal uncle..if not then a maternal uncle..if not..and so on) be present in a nikah done online?
Can a shaikh see and/or hear the *agreement* of the sister signing the nikah contract?
Can the witnesses fulfill the conditions of *witnessing the nikah?* (i.e. see a wali present..hear the amount of the mahr..see the groom..hear or be assured of the bride's agreement to the marriage..etc.)
These are *fundamental* conditions of nikah which have to be present..the condition of dowry can have variations..as it can be handed over in material..money..in payments..or even electronic deposit..but the conditions listed above are *critical* because just for a couple of quick and *valid* examples..Rasulullah (saaws) said:
"There's no nikah without a wali" [cited by Abu Dawood, Al-Tirmidhi, Ibn Majah, and authenticated by Al-Albani]
"Whichever woman, performed nikah without the permission of her wali; her nikah is invalid, her nikah is invalid, her nikah is invalid" [cited by Ahmad, Abu Dawood, Al-Tirmidhi, and authenticated by Al-Albani]
It is only *cautionary*..that a nikah takes place in its *traditional* and *common* form..so it may guarantee the rights of *both sides* involved in it..and so the fulfillment of its conditions be stable and *clear* as to not have *doubt* or *conflicts* later on
